The provision in H.R. 5371 that reclassifies cannabis seeds and restricts their shipping is scheduled to go into full effect on November 12, 2026.

A major change within this bill has closed the legal loophole that previously allowed the interstate shipping of cannabis seeds. Under the new law, cannabis seeds will no longer be considered a hemp product.

This bill reclassifies cannabis seeds as a marijuana product, solely because they originate from a plant that exceeds 0.3% THC.

This single change effectively ends national seed shipping. Once the law goes into effect, you will no longer be able to have seeds mailed to you.
