June 26, 2018, Oklahoma voters approved State Question 788 legalizing medical marijuana, making it the 30th state to do so.
Rules for Oklahoma's medical marijuana program:
Oklahoma has a very permissive medical marijuana law that allows access for any medical condition a doctor deems appropriate. There is no list of qualifying conditions.
Patients must obtain a medical marijuana license by getting a physician's written recommendation. Licenses must be renewed annually.
Dispensaries are broadly allowed and licensed by the Oklahoma Medical Marijuana Authority. There are over 2,000 licensed dispensaries in operation.
Approved products include smokable marijuana flower, edibles, tinctures, oils, topicals and more. There are no restrictions on types of products.
Home cultivation is permitted for licensed patients. Individuals can grow up to 6 mature plants at a time.
Possession limit for patients is up to 3 ounces of marijuana on their person, and up to 8 ounces at their residence.
The program has few purchase, use or product restrictions compared to most states. High-THC products are permitted.
Consumption of medical marijuana is prohibited in public places, on federal lands, and in other locations as deemed unlawful.
Driving under the influence of medical marijuana remains illegal and patients can be charged with DUIs if impaired while driving.
Medical marijuana patient licenses must be shown to law enforcement officers when in possession of allowable quantities of medical marijuana.
Unlicensed possession and use of marijuana remains a criminal offense in Oklahoma outside of the medical marijuana program.
